Marc D. Stern will be presenting on the topic of Continuing The Conversation: International Humanitarian Law and National Security: Recalibrating (or Reclaiming) the Balance.

This seminar provides 1.5 CLE credits (pending).

Marc D. Stern, Associate General Counsel for Legal Advocacy of American Jewish Committee, is one of the most respected lawyers in the United States on church-state and religious liberty issues. He has argued four times in front of the U.S. Supreme Court regarding First Amendment issues (read more here).

Program Presentation: Most current international humanitarian law was drafted with inter-state conflict in view. Today, however, most warfare is between states and non-state actors, many of whom are justly described as terror groups, paying little or no mind to international law. This leaves democratic nations, such as Israel and the U.S., at a distinct disadvantage in responding to such groups militarily. The problem is compounded by the introduction of international human rights law--designed with ordinary police work, not combatting missile equipped irregular forces--as a restraint on the use of military force. The session will survey problem areas such as indefinite detention of terrorists, the allowance for irregular forces to engage in military activities without wearing uniforms, the problem of revolving door terrorists and the problem of proportionality.
